1. Agreement to Terms

By downloading, installing, accessing, or using Pup AI (the "App") and related websites, services, and features (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Who We Are

Pup AI is operated by Samuel Downey, doing business as "Pup AI" (collectively, "Pup AI," "we," "us," or "our").

3. Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction, if higher). If you are under 18, you represent you have parental/guardian consent.

4. Authentication & Apple ID

  • The App uses Apple ID for authentication through Sign in with Apple.
  • You are responsible for maintaining the security of your Apple ID and all activity that occurs through your authenticated session.
  • Notify us immediately at pupaihelp@gmail.com if you believe your access has been compromised.

5. Subscriptions, Trials & Billing

  • Apple Controls Billing: All subscriptions and payments are handled exclusively by Apple through the App Store. We do not process payments directly.
  • Subscription Management: To manage, cancel, or request refunds for your subscription, you must use your Apple ID subscription settings. We cannot directly cancel or refund subscriptions.
  • Pricing & Terms: Current pricing, billing periods, auto-renewal, and trial terms are displayed in the App Store at the time of purchase.
  • Apple's Policies Apply: All billing, refunds, and subscription matters are governed by Apple's App Store terms and policies. Contact Apple Support for billing issues.
  • No Direct Refunds: We cannot issue refunds directly. All refund requests must go through Apple's refund process.

6. In-App Purchases & Third-Party Platforms

Purchases made through app stores are governed by their policies. We are not responsible for billing errors or issues on those platforms.

7. Not Veterinary or Professional Advice - Important Disclaimer

  • Educational Purpose Only: Pup AI provides educational information and AI-generated suggestions. It is NOT veterinary, medical, legal, or professional advice.
  • Professional Consultation Required: Always consult a licensed veterinarian or qualified trainer for health or behavioral concerns. In emergencies, contact a professional immediately. Do not delay professional care based on AI suggestions.
  • AI Limitations: AI outputs can be inaccurate, incomplete, or entirely incorrect (hallucinations). The AI may confidently provide false information. Always verify important information with qualified professionals.
  • No Liability: We are not liable for any harm resulting from reliance on AI-generated content. You assume all risks associated with using AI suggestions.

8. Goals, Milestones & Scan Feature

  • The App may help you set and track training/health goals, issue milestone notifications, and analyze images to infer body language, mood, stress signals, or breed.
  • These are estimates and may be wrong. Do not rely on them as sole evidence of a condition or trait.
  • Breed collection and similar features are for entertainment/educational purposes only.

9. User Content & License

  • "User Content" includes data, text, photos, videos, and other material you submit (e.g., dog photos, chat messages, goal updates).
  • You own your User Content. By submitting it, you grant Pup AI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, translate, distribute, and display such content solely to operate, maintain, and improve the Services.
  • You represent you have all rights to your User Content and it does not infringe third-party rights or violate laws.

10. Acceptable Use

You agree not to:

  • Use the Services unlawfully or harmfully.
  • Upload content that is defamatory, obscene, hateful, or promotes violence/animal cruelty.
  • Reverse engineer or attempt to extract source code (except as allowed by law).
  • Interfere with or disrupt the Services or servers.
  • Use bots/scrapers without our permission.
  • Impersonate others or misrepresent affiliation.

11. AI, Data Usage & Memory

  • We use machine learning to process your inputs (chats, photos) to generate outputs and maintain context ("memory").
  • All data is stored locally on your device. We do not retain any user data on our servers.
  • AI processing is handled through Google's services (Gemini model).
  • See our Privacy Policy for details on collection, retention, rights, and deletion requests.

12. Feedback

If you send ideas or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without obligation or compensation.

13. Third-Party Links & Services

The Services may link to third parties. We are not responsible for their content or policies. Access at your own risk.

14. Intellectual Property

  • The Services (text, graphics, logos, software) are owned by Pup AI or its licensors and protected by IP laws.
  • Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.

15. Suspension & Termination

We may suspend or terminate access, with or without notice, if you violate these Terms or for any reason. You may stop using the Services at any time. Sections that should survive termination (e.g., IP, disclaimers, liability limits) will remain in effect.

16. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUP AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO: (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY THIRD-PARTY CONDUCT OR CONTENT; (C) CONTENT OBTAINED THROUGH THE SERVICES; OR (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IF LIABILITY IS FOUND, OUR AGGREGATE LIABILITY SHALL NOT EXCEED (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (ii) ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.

18. Indemnification

You agree to defend, indemnify, and hold harmless Pup AI and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms.

19. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Ohio, without regard to conflict of law rules.
  • Dispute Venue: Any dispute shall be resolved exclusively in the state or federal courts located in Franklin County, Ohio. You consent to such jurisdiction and venue.

20. Changes to the Services

We may modify, suspend, or discontinue the Services (or any part) at any time, without liability.

21. Changes to These Terms

We may update these Terms. When we do, we'll revise the "Last Updated" date. Changes are effective when posted (or as otherwise notified). Continued use signifies acceptance.

Your use of the Services is also governed by our Privacy Policy: Privacy Policy.

23. App Store Terms

If you downloaded via Apple App Store or Google Play:

  • Apple/Google are third-party beneficiaries of these Terms and may enforce them.
  • You acknowledge they have no obligation to provide maintenance or support for the App.

24. Export & Sanctions Compliance

You agree to comply with all applicable export control and sanctions laws. You represent you are not located in a sanctioned country or on a restricted party list.

25. Severability & Waiver

If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.

26. Assignment

You may not assign these Terms without our prior written consent. We may assign them without restriction.

27. Entire Agreement

These Terms, the Privacy Policy, and any policies referenced herein constitute the entire agreement between you and Pup AI regarding the Services.
