1. Agreement to Terms

By downloading, installing, accessing, or using Pup AI (the "App") and related websites, services, and features (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Who We Are

Pup AI is operated by Samuel Downey, doing business as "Pup AI" ("Pup AI," "we," "us," or "our").

3. Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction, if higher). If you are under 18, you represent you have parental/guardian consent.

4. Authentication & Apple ID

The App uses Apple ID for authentication through Sign in with Apple. You are responsible for maintaining the security of your Apple ID and all activity through your session. Notify us immediately at pupaihelp@gmail.com if you believe your access has been compromised.

5. Subscriptions, Trials & Billing

Apple Controls Billing: All subscriptions and payments are handled exclusively by Apple through the App Store. We do not process payments directly.
Subscription Management: To manage, cancel, or request refunds, use your Apple ID subscription settings. We cannot directly cancel or refund subscriptions.
Pricing & Terms: Current pricing, billing periods, auto-renewal, and trial terms are displayed in the App Store at purchase.
Trial Periods: If you sign up for a free trial, your account will automatically be charged the subscription fee when the trial ends unless you cancel at least 24 hours before the trial expires. Any unused portion of a trial is forfeited when you purchase a subscription.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the period’s end.
Cancellation: You can cancel anytime in your Apple ID Account Settings. Cancellations take effect at the end of the current billing cycle; you retain access until that time.
Billing Authorization: By confirming your purchase, you authorize Apple to charge your Apple ID account for the subscription and any applicable taxes.
No Direct Refunds: We cannot issue refunds directly. All refund requests must go through Apple’s refund process.

6. In-App Purchases & Third-Party Platforms

Purchases made through app stores are governed by their policies. We are not responsible for billing errors or issues on those platforms.

7. Not Veterinary or Professional Advice – Important Disclaimer

Pup AI provides educational information and AI-generated suggestions only. It is NOT veterinary, medical, legal, or professional advice.
Always consult a licensed veterinarian or qualified trainer for health or behavioral concerns. In emergencies, contact a professional immediately.
AI outputs may be inaccurate, incomplete, or incorrect. Do not rely on AI responses as sole evidence for decisions.
We are not liable for any harm resulting from reliance on AI-generated content. You assume all risks associated with using AI suggestions.

8. Goals, Milestones & Scan Feature

Goal tracking, milestone notifications, and scan analysis (e.g., breed, mood, stress signals) are estimates only and may be inaccurate.
Breed collection and scan results are for entertainment and educational purposes only.

9. User Content & License

You retain ownership of all content you provide (e.g., dog photos, notes, chats). By submitting it, you grant Pup AI a non-exclusive license to use it solely to operate and improve the Services.

10. Acceptable Use

You agree not to misuse the Services (e.g., unlawful use, animal cruelty content, reverse engineering, scraping, impersonation, or disruption).

11. AI, Data Usage & Memory

Inputs (chat, photos) are processed with AI to generate outputs and maintain context.
Data is stored locally on your device. We do not retain user data on our servers.
AI processing is powered by Google’s Gemini model. See our Privacy Policy for details.

12. Feedback

By submitting ideas or suggestions, you grant Pup AI a royalty-free license to use them.

13. Third-Party Links & Services

We are not responsible for third-party content or services. Access at your own risk.

14. Intellectual Property

The App and Services (logos, software, content) are owned by Pup AI or licensors and protected by law.

15. Suspension & Termination

We may suspend or terminate your access at any time for violations or other reasons.

16. Disclaimers

The Services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free use.

17. Limitation of Liability

To the maximum extent permitted by law, Pup AI and affiliates are not liable for indirect, incidental, or consequential damages. Aggregate liability is limited to the greater of (i) the amount you paid in the past 12 months, or (ii) $100 USD.

18. Indemnification

You agree to indemnify and hold harmless Pup AI from claims arising from your use of the Services.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of Ohio, USA. Disputes will be resolved exclusively in courts located in Franklin County, Ohio.

20. Changes to Services & Terms

We may modify or discontinue the Services at any time. Updates to these Terms will be posted with a new “Last Updated” date.

21. Privacy Policy

Your use of the Services is also governed by our Privacy Policy.

22. App Store Terms

If downloaded via Apple App Store or Google Play, Apple/Google are third-party beneficiaries of these Terms.

23. Export & Sanctions Compliance

You agree to comply with all applicable export control and sanctions laws.

24. Severability & Waiver

If any provision is unenforceable, the rest remain in effect.

25. Assignment

You may not assign these Terms without consent; we may assign without restriction.

26. Entire Agreement

These Terms, plus our Privacy Policy, constitute the entire agreement between you and Pup AI.
